Yep. Because an elected representative should listen to his constituency rather than acting on his own whim. That does not preclude him from expressing his private opinion, though.

So his private opinions don't count, since he will be voting in accordance with what his constituents want. This is great for a lawmaker, but not for a Chief Executor, whom McCain aspires to become.

This means (if he is consistent enough on both counts), that should a bill effectively repealing Roe v. Wade reach his desk as President, he might veto it, but if an appeal related to Roe v. Wade reaches the SCotUS and they overturn it, he would be pleased.

Nobody cares about whether he'll veto a bill that is null and void in vitro. What's important is whether he will appoint justices that believe Roe v Wade is a bad precedent and should be overturned, or the sort that believes Roe v Wade is a good precedent and should be re-affirmed.

If he's in support of the former type, he's anti-choice and that's the end of story.

Incidentally, I am 99.999% sure he'll appoint the latter type. The guy's pro-choice, he just has to toughen up the rhetoric now.

No particular reason, I guess. Nobody really thinks that it's feasible, practical, possible or in any way contributive to the pro-life cause to "repeal" Roe by an act of Congress.


And what should a guy say if he is for Roe v. Wade for the pro-choice reasons, but against it for the 10th Amendment reasons?

That guy shouldn't say anything - he needs to catch up on his constitutional law studies and figure out what exactly "pro-choice" reasons are. For the life of me I don't see how 10th Amendment can even apply here.

The powers to regulate cosmetic (as in "medically unnecessary") procedures have not been delegated to the United States by the Constitution, therefore they are reserved for the States. The Supreme Court should have refused to consider the case.

Я все никак не пойму, при чем тут прочойс/пролайф. Казалось бы, малоинтересное внутреннее техасское дело. Вы живете в Калифорнии, я в Иллиное, хозяин журнала - в Массачуссеттсе. Кому нужна война с Техасом за освобождение женщин? Почему тогда не с Ираком?

Ну, с такой точкі зренія Массачусеттсу было бы экономіческі выгодно, еслі б Roe vs Wade отменілі (у нас аборты, очевідно, ні за что не отменят, а дополнітельный доход в віде налогов с доходов врачей, гостініц і харчевен штату не помешает). Так что пора начінать агітіровать местных лібералов за его отмену :)

А что именно могут сделать Калифорнии судьи с четкой позицией против абортов? Если вы опасаетесь, что они смогут из своего Вашингтона запретить калифорнийские аборты -- то это именно то, к чему стремилась Ро: управлять штатами из Вашингтона. Этим он и вреден.

Если вам пофигу конфликт между федеральным и штатным, почему вы имеете точку зрения на случай Ро и Вейда? Он целиком посвящен этому конфликту, и ничему другому.

Мне нравятся аборты в Иллиное, И ОДНОВРЕМЕННО мне не нравится навязывание законов (любого содержания) Техасу. Что в этом нелогичного или хотя бы странного? Иллиной это Иллиной, а Техас это Техас.
